Terms of Service

1. Account​

By creating an account on ScentSell, you agree to provide accurate information, maintain the security of your account credentials, and accept responsibility for all activity on your account. ScentSell reserves the right to suspend or terminate accounts that breach these terms.

You must be 18 years of age or older to create a seller account. Buyer accounts require you to be at least 18, or have guardian consent.

2. Listings​

Sellers are responsible for the accuracy of all listing content including descriptions, photos, fill levels, condition ratings, and authenticity. Listings must represent genuine items you own and have the right to sell.

ScentSell reserves the right to remove, edit, or decline any listing at its discretion. All listings go through an approval process before being made visible to buyers.

3. Buying​

By completing a purchase on ScentSell, you agree to pay the listed price plus any applicable shipping charges. Payments are processed by Stripe. ScentSell does not store card details.

4. Selling​

By listing an item for sale, you warrant that: (a) you own the item; (b) it is genuine and accurately described; (c) you will dispatch it within the agreed timeframe after payment. Destination charges via Stripe Connect mean you receive 85% of the sale price at checkout, minus Stripe's processing fees.

5. Prohibited Items​

The following are prohibited on ScentSell:

  • Counterfeit or fake fragrances
  • Items listed as genuine that are not
  • Stolen goods
  • Items prohibited by Australian law
  • Fragrance samples or testers represented as full retail bottles

Listing prohibited items results in permanent account termination and may be referred to relevant authorities.

6. Intellectual Property​

All content on the ScentSell platform — including the ScentSell name, logo, design, and proprietary technology — is the property of ScentSell. Sellers retain ownership of their listing content (photos, descriptions) but grant ScentSell a non-exclusive licence to display that content on the platform.

7. Dispute Resolution​

Disputes between buyers and sellers are mediated by ScentSell admin using the formal dispute process. Admin decisions are final. For disputes ScentSell cannot resolve, users may escalate to their state consumer affairs body or the ACCC. See Dispute resolution.

8. Liability​

ScentSell operates as a marketplace and facilitates transactions between buyers and sellers. ScentSell is not the seller of any listed item and is not liable for item condition, authenticity, or delivery unless directly at fault. To the maximum extent permitted by Australian law, ScentSell's liability is limited to the transaction value in dispute.

9. Termination​

ScentSell may terminate or suspend your account for breach of these terms, fraudulent activity, or at its discretion with reasonable notice. You may close your account at any time via Account Settings → Delete account.

10. Changes to Terms​

ScentSell may update these terms at any time. Continued use of the platform after changes are published constitutes acceptance. Material changes will be communicated via email to registered users.
